Court Urged to Dissolve UDA.

A daring petition has been filed at the High Court demanding the immediate dissolution of the United Democratic Alliance (UDA) — the ruling party that brought President William Ruto to power.

In a move that could trigger a constitutional crisis, the petitioners are urging the court to compel Registrar of Political Parties, Ann Nderitu, to de-register UDA, claiming the party is operating illegally and in gross violation of the Political Parties Act.

UDA in the Eye of the Storm

According to the explosive petition, UDA’s formation, constitution, and operations are marred with irregularities. The petitioners allege that the party’s internal structures were never properly constituted and that it continues to operate without meeting the legal standards required of a registered political party in Kenya.

The petition accuses the party of:

  • Lacking transparent internal elections
  • Operating with an incomplete or irregular party constitution
  • Violating key sections of the Political Parties Act, 2011

The petition goes further to accuse the Registrar of being complicit in these irregularities by failing to hold the party accountable, despite mounting evidence.

Political Fallout Could Be Devastating

If the court grants the request, UDA could be completely de-registered — a move that would displace hundreds of elected leaders, including MPs, governors, senators, and even President Ruto himself, who rode into power on the party’s ticket.

Legal experts say such a move would be unprecedented in Kenya’s history and could spark nationwide by-elections, throw Parliament into disarray, and potentially collapse key functions of government.

Deputy President, William Ruto addresses UDA party aspirants at Wild waters in Mombasa. He wants aspirants who cause chaos during campaign period to be disqualified. 18th October 2021.

“We are staring at a constitutional earthquake,” said political analyst Dr. Mercy Nyaboke. “No one expected this level of legal confrontation against a sitting government.”

Registrar of Political Parties Under Fire

The petition places the Registrar, Ann Nderitu, at the center of the storm. She’s accused of failing in her constitutional duty to ensure all political parties comply with the law.

Public pressure is mounting for her to step aside, as calls for an independent review of her office grow louder across civil society and political circles.

What’s Next?

The High Court is expected to set a hearing date within days. Political players across the spectrum are closely watching how the judiciary will handle what could become the most consequential legal battle in Kenya’s democratic era.

Meanwhile, insiders within UDA have confirmed that crisis meetings are underway, with senior party officials working on an emergency legal defense.

Bottom Line

This is no ordinary legal challenge. It’s a high-stakes attempt to dismantle the very party in power—and if successful, it could trigger the greatest political realignment Kenya has seen in decades.
