A Court of Appeal ruling has favoured book publisher Anthony Kioi in a copyright dispute.

The court issued a permanent injunction preventing Gichuki from using the trademarked “High Flyer Series” brand which Kioi registered in 2006.

Gichuki, who continued publishing under the Comprehensive Topical brand after their split, was found to have misused Kioi’s trademark. 

The High Court initially ruled in Gichuki’s favour but the Court of Appeal overturned this, stating that Gichuki’s actions were intended to confuse consumers.  

The ruling includes a ban on all activities related to the trademarked brand which features a flying eagle holding books.
