High Court Overturns Muigai’s Appointment

President William Ruto must reconsider his appointments after the High Court annulled the appointment of Captain Kungu Muigai, a cousin of former President Uhuru Kenyatta, as Chairperson of the Kenya Cultural Centre Council, which lasted less than a year.

The court deemed the appointment null and void in response to a petition that contested its legality.

David Njoe Kithunka filed the petition, asserting that the then Cabinet Secretary, Ababu Namwamba, acted unlawfully in appointing Muigai.

Kithunka contended that Namwamba neglected the Kenya Cultural Centre Council’s authority by directly appointing Muigai to the position, contrary to the law.

Justice Lawrence Mugambi ruled that the appointment must be revoked immediately, describing it as invalid and void.

Muigai was set to serve on the council as chairperson until January 20, 2025. However, the ruling did not address the implications of his nearly full term served.

Muigai’s appointment occurred on January 21, 2023, through a gazette notice issued by Namwamba.

In light of this, Justice Mugambi instructed the Kenya Cultural Centre Council to elect a new chairperson in accordance with the law.
