DP Rigathi Gachagua Files Court Motion to Stop Impeachment

Deputy President Rigathi Gachagua has taken legal action to prevent his impeachment by filing a petition in the High Court. He argues that the impeachment motion, which was introduced in the National Assembly, is based on deceit and misrepresentation.

Gachagua claims that the motion is politically motivated. He believes it undermines the will of the Kenyan people. He asserts that it is unconstitutional and aimed at achieving unjust goals.

In his petition, Gachagua accuses National Assembly Speaker Moses Wetangula and Deputy Speaker Gladys Shollei of bias. They have publicly expressed their preferences about the impeachment process.

He contends that the National Assembly has not allowed enough time for public participation. He believes that this participation is essential for fair engagement. He considers it necessary for reasonable engagement on such a significant matter.

This latest legal move follows three earlier petitions that Gachagua filed to challenge the impeachment process. The High Court dismissed all of these petitions. A three-judge bench rejected the most recent effort to halt the impeachment.

They did not grant interim orders to stop the proceedings. The court has scheduled a mention for the involved parties on October 10, indicating that the legal battle is ongoing.

As the situation develops, public participation in the impeachment motion is set to start on October 4. Gachagua’s legal team is seeking an order. They want to prevent the National Assembly from processing any resolutions.

These resolutions are related to the impeachment motion filed on September 26. This highlights the contentious nature of the political climate in Kenya.
