Lawyer Shares Update on Gachagua’s Health Condition

The lawyer informed the Senate plenary on Thursday. Gachagua has been ordered to remain on bed rest for the time being. Noting that he was unable to speak directly to the DP, he communicated with his doctor.

Muite further clarified that Gachagua is not choosing to avoid appearing before the Senate for his impeachment trial. “I have successfully contacted the doctors at Karen Hospital. ” A team of doctors is caring for DP Gachagua. Due to his condition, I was advised by his doctors not to communicate with him directly, as he requires complete rest for the time being. “I was, however, informed that he is currently experiencing severe chest pains,” Muite asserted.

In his response, Muite requested that the Senate consider adjourning the hearing to Tuesday, October 22. However, lawyers representing the National Assembly have stated their willingness to forgo the cross-examination of Gachagua and are requesting that the impeachment motion proceed.

“The Deputy President has chosen not to appear in the Senate… in the interest of justice and considering the gravity of removing a Deputy President from office, I urge you to grant him a couple of days,” Muite argued.

He further added, “To potentially save the time of this honorable House, let me invite Mr. Speaker and the House, please refer to Article 145(6) of the Constitution, which states, “If the special committee reports that the particulars of any allegations against the president/deputy president have been substantiated, the Senate shall, after providing the president an opportunity to be heard, vote on the impeachment charges.

” “I therefore leave the matter in your hands. ” I would suggest that Article 145 (6b) does not have a time limit; allow the DP a couple of days,” added Muite.

Eric Gumbo, one of the lawyers representing the National Assembly, argued that Gachagua would not be prejudiced if the Senate were to proceed with the hearing. According to Gumbo, the law allows a person to either appear in person, submit responses via affidavits, or be represented. Thus, Gumbo has requested that the impeachment trial, scheduled to conclude on Thursday, proceed as planned.

At 3 PM, it was disclosed that Gachagua became ill and was quickly taken to the hospital just minutes before he was to testify in an impeachment hearing against him in the Senate.

His attorney, Paul Muite, informed senators that his client fell ill after the lunch break during the impeachment trial. Today marks the day when senators are anticipated to vote on the 11 charges against Gachagua.

Muite informed the Senate, “The unfortunate reality is that the Deputy President of the Republic of Kenya has fallen severely ill, and as I address Mr. Speaker and this House, he is currently in the hospital. ” He further stated, “That is the unfortunate reality.
