2 MCAs Face Trouble Over Theft and Firearm Misuse

Two MCAs are facing legal challenges due to allegations of theft and misuse of firearms.

According to the police, an MCA from Kitui was recorded by CCTV allegedly stealing a parcel intended for Mombasa.

The Directorate of Criminal Investigations (DCI) confirmed the arrest was based on the examination of CCTV images.

In a different incident in Kajiado county, one MCA was formally charged on Thursday with three offenses: misuse of a firearm, obstruction of a police officer, and disturbing the peace.

Two Members of County Assembly are under legal scrutiny in unrelated cases of theft and firearms misusage, prompting renewed concerns about the accountability of elected leaders.

In Nairobi, authorities apprehended a Kitui county MCA on Tuesday afternoon linked to the alleged theft of mobile phone accessories worth around Sh1.9 million.

A private courier service reported that the items went missing on February 8 while supposedly on their way to a client in Mombasa.

The Directorate of Criminal Investigations (DCI) stated the arrest resulted from reviewing CCTV footage that purportedly captured the suspect taking the parcel from the courier’s location.

“The arrest came after a positive identification was made following the analysis of CCTV evidence, which recorded the individual leaving with the parcel intended for a client,” remarked the DCI.

The person, who did not disclose his status as an elected representative, was apprehended by security personnel at the company’s office on River Road and later transferred to Central police station.

“Upon being spotted at the River Road courier offices in Nairobi, the suspect was detained by security staff, who subsequently handed him over to the police,” explained the DCI.

“At the police station, he was identified and then transferred to Mombasa detectives for further processing. ”

In a separate case from Kajiado county, an MCA was charged on Thursday with three offenses: misuse of a firearm, obstruction of a police officer, and creating a disturbance.

Per the DCI, these charges arose from an incident on December 4, 2023, in Ngurunga, Emakoko, where authorities were attempting to arrest individuals involved in assault and property damage.

During the operation, the MCA allegedly intervened with a group exceeding 10 armed individuals.

“The area MCA arrived accompanied by over 10 individuals wielding sticks and knives, who attacked the unarmed officer guarding the arrested suspect and forcibly released him,” reported the DCI.

The MCA is also accused of displaying a pistol and confronting the police vehicle containing the detained suspect.

“With a pistol in hand, the MCA led the group to assault the police vehicle while issuing threats,” the statement detailed.

Two armed officers present at the scene, who had entered a nearby house to carry out additional arrests, intervened to protect their colleague and managed to disperse the assailants.

The case was transferred to DCI Isinya, which later forwarded the file to the Office of the Director of Public Prosecutions (ODPP).

The ODPP then approved the prosecution.
“DCI Isinya assumed control of the inquiry and submitted the case documentation to the ODPP, which authorized it for prosecution,” the agency reported.

Both cases remain under active scrutiny as law enforcement agencies reiterate their dedication to enforcing the rule of law, regardless of a person’s social status.
