Sonko Triumphs Again: Court Orders Former MP to Refund Ksh7.9 Million in Landmark Ruling.

In a dramatic verdict shaking the land registration scene, the Kwale High Court today directed former Member of Parliament Omari Zonga to repay KSh 7,905,040 to a private company after being found liable in a contentious land dispute that also implicated ex-Governor Mike Sonko.

The ruling not only rejected the plaintiff’s attempt to revoke Sonko’s title deed but also unequivocally placed the financial burden and accountability squarely on Zonga’s shoulders.

Double Sale Uncovered, Evidence Unraveled

According to the court, Zonga had sold the same parcel of land twice — first to Mike Sonko in 2013, then again in April 2014 to the private company for KSh 7.75 million. The buyer claimed ignorance of the earlier transaction and sought cancellation of Sonko’s title, alleging fraud in the deed issuance.

Sonko defended his position, stating he lawfully purchased the land and was granted the title deed on March 26, 2013. The court found no credible evidence that his title was obtained through wrongdoing.

Facing weighty burdens of proof inherent in fraud cases, the plaintiff’s case against Sonko collapsed. As the court declared: it is Zonga — not Sonko — who bears the responsibility for inconsistent disclosures and the double transaction.

Judgment Breakdown: What Zonga Must Pay

Zonga was ordered to repay:

  • KSh 7,750,000 — the purchase price he secured from the private company
  • KSh 155,040 — stamp duty costs
    Total: KSh 7,905,040

The court emphasized that Zonga’s own pleadings contradicted claims against Sonko, effectively exonerating the former governor from fault.
