Kenyatta University Slammed with Sh850K Penalty for Blocking Student’s Graduation.

A stunning verdict from the High Court has rocked Kenyatta University, as it has been ordered to compensate a student a staggering Sh850,000 for denying her a chance to graduate after mysteriously withholding her academic results.

In a dramatic ruling that has sent shockwaves through Kenya’s education sector, Justice Lawrence Mugambi declared that the institution, together with one of its lecturers, Dr. Linda Kimencu, violated Nyambura Kimani’s constitutional rights by failing to release her Continuous Assessment Test (CAT) results.

Nyambura had completed all her coursework — including over the required 49 units — yet she found herself blocked from graduating, simply because her UCU 104 CAT marks were never published.

“The actions of the university and its staff were not only unjust and unreasonable but blatantly unlawful,” Justice Mugambi ruled, citing violations of Article 47 of the Constitution and Nyambura’s right to fair administrative action.

The court didn’t stop there. It also ordered the university to immediately include Nyambura in its next graduation list — placing her among the first graduates in recognition of her academic merit and perseverance.

According to court documents, Nyambura claimed the university’s actions were “irrational, abusive of power, and a direct assault on her dignity.” She argued that both KU and Dr. Kimencu had not only infringed on her right to education but had also violated the Fair Administrative Actions Act and Article 28, which safeguards personal dignity.

The shocking revelation has stirred outrage online and raised serious questions about accountability in Kenya’s public universities, with many Kenyans now demanding transparency and reform in how student records are managed.

This case could set a major precedent in student rights, and observers say it may open the floodgates for other affected students to seek legal redress.

As Nyambura finally prepares to don her graduation gown, Kenyatta University is left with a bruised reputation — and a heavy financial bill.
