The political and administrative conflict in Homa Bay County reached the Employment and Labour Relations Court when Deputy Governor Oyugi Magwanga submitted a groundbreaking legal case against Governor Gladys Wanga.
The legal action, which had never been seen before, shows that the county government faces leadership problems one year into their term. The upcoming 2027 elections will create political disputes that will result from this stage in the electoral process.
Magwanga submitted his petition to the court on February 4, 2026, asking the judge to order Governor Wanga to provide him access to his office and to restore his official vehicles and fuel allowance while stopping everything that he sees as hindering his rights as an elected deputy. He accused the governor of acting against the law by taking actions that made him unable to work while he continued to receive a salary from public funds.
The court document states that the petitioner asks for general damages because his constitutional rights were violated, which shows how serious the case has become that now exists before Kenya’s judicial system.
Magwanga told journalists he went to Governor Wanga to propose a solution for their conflict before the court delivers its decision. He claimed that the standoff harms Homa Bay residents because their leaders should work together instead of fighting each other. The governor changed the locks to his office in December 2025, and he took away essential resources without giving any formal notice.
The crisis presents hidden political dimensions that extend beyond its surface-level issues. Magwanga, who had previously run for governor and served as Wanga’s running mate in the 2022 election, announced his plans to run for the county’s top position in the 2027 elections, which will create a direct electoral competition between them. He has also condemned the governor’s management of the state because she claims ownership of national government initiatives while she fails to show how county resources were used.
The governor has not yet provided a response to the legal document because the court case has become public, which shows ongoing conflicts within the county’s executive branch after the previous cabinet changes that removed the deputy from his position. The analysts predict that the political fallout will affect how the county operates its government and how political parties will support candidates during the forthcoming national elections.
