The High Court has told the Government to take control of assets that are believed to belong to former Kiambu County Governor Ferdinand Waititu, which are worth Ksh.76.2 million.Additionally, two pieces of land valued at Ksh.32 million and one piece of land that belongs to his wife, Susan Ndung’u, must also be handed back to the Government.This decision came after the court discovered that Waititu and his wife could not clearly explain where these assets came from.Waititu and his wife fought against the case, claiming that the assets were legally obtained through loans and business earnings before he took office as governor.
Besides the two pieces of land, there were also other items, including a Caterpillar machine valued at Ksh.11 million and two cars worth Ksh.600,000 each.In his decision, Justice Nixon Sifuna partly supported a civil case brought by the Ethics and Anti-Corruption Commission (EACC), which aimed to recover assets that were supposedly obtained illegally while Waititu was governor. The EACC wanted to get back assets worth Ksh.1.9 billion, but the court only allowed the seizure of a limited number of assets that they could not properly explain.
The court turned down the EACC’s request to take money from several bank accounts linked to Waititu, his wife, and their businesses.Justice Sifuna stated that the claims from the commission regarding these accounts were not presented clearly or backed up by strong evidence.In February 2025, the former governor was found guilty of having a conflict of interest in a corruption case involving Ksh.588 million.He was given a 12-year prison sentence or a Ksh.52.5 million fine, and his wife, Susan Ndung’u, received a one-year prison sentence or a Ksh.500,000 fine.
