The High Court has issued a dramatic injunction stopping attempts to oust Mombasa County Assembly Majority Leader Athman Rama Mwamiri in a case that has shaken the coastal political scene.
Justice Jayrus Ngara ruled that Mwamiri should remain in office until the matter is fully heard and determined, dealing a major blow to rivals who had already announced his replacement.
The court directed the County Assembly, its Speaker, and nominated MCA Priscilla Mema Mumba to refrain from interfering with Mwamiri’s position, saying the process of his removal raised serious legal concerns.
Mwamiri rushed to court under a certificate of urgency, arguing that his alleged removal was unconstitutional and violated assembly standing orders. He insisted that only his political party has the authority to appoint or remove the Majority Leader, and no such party resolution was made.
Through his lawyer, he further claimed that his rights to fair administrative action and fair hearing were ignored, pointing to a lack of proper communication, minutes, or official documentation supporting the decision to oust him.
The court found merit in his arguments and gave the respondents seven days to file their responses. The case will be mentioned on September 17 for further directions.
The ruling means Mwamiri continues to enjoy all privileges of the Majority Leader’s office, including his role in the County Assembly Service Board, while political tensions in Mombasa escalate.
Observers say the decision could set a precedent for how political disputes within county assemblies are handled, with the courts now playing a critical role in enforcing procedure and protecting leadership positions from abrupt changes.
As the legal battle heads to its next stage, the power struggle inside the Mombasa County Assembly is far from over.
