Explosive High Court Petition Seeks to Bar COTU Chief from Sixth Term

A high-stakes legal petition has been filed at the High Court seeking to permanently debar Francis Atwoli from seeking re-election as the secretary-general of the Central Organization of Trade Unions (COTU).

The constitutional challenge, which threatens to end Atwoli’s decades-long stranglehold on Kenya’s labor movement, alleges that his continued incumbency violates the principles of good governance and term limits enshrined in the Constitution. The petitioner argues that the veteran trade unionist has transformed the workers’ body into a personal fiefdom, stifling democratic transition and the infusion of fresh leadership within the labor sector.

This judicial offensive comes at a sensitive time for the trade union giant, who has remained a polarizing figure in both industrial relations and national politics. The petition claims that the current COTU constitution was “clandestinely amended” to remove age barriers and term restrictions, an act the court is now being asked to declare null and void.

Should the court grant the conservatory orders sought, it would effectively freeze the upcoming COTU elections, plunging the organization into a leadership vacuum. Legal experts suggest this is the most significant threat to Atwoli’s power since he took the helm in 2001. The petitioner further contends that the Secretary-General’s dual role in partisan politics compromises his ability to impartially represent the interests of the Kenyan worker.

The ODPP and the Registrar of Trade Unions have been mentioned as interested parties in a case that could redefine the future of collective bargaining in East Africa. If successful, the suit would not only block Atwoli’s sixth term but also trigger a forensic audit into the financial management of union dues collected over the last twenty years.

As the labor movement holds its breath, the “Atwoli Era” faces its ultimate test in a courtroom rather than at the ballot box. The ruling on this petition is expected to send shockwaves through the political landscape, potentially dismantling one of the most formidable power structures in the country.
