The Office of the Director of Public Prosecutions (ODPP) has launched a high-stakes legal offensive against Trans Nzoia Governor George Natembeya, a move that threatens to reignite a decade-old corruption scandal.
In an urgent memorandum of appeal filed this week, the ODPP is seeking to overturn a recent High Court decision that cleared the governor of all charges related to the alleged irregular procurement of a multi-million shilling official vehicle during his tenure as a senior administrator in the former Nairobi County government.
The prosecution’s intervention comes as a significant blow to Natembeya, who had recently celebrated the High Court’s acquittal as a definitive vindication. However, state prosecutors argue that the lower court erred fundamentally in its assessment of the evidence, claiming that the acquittal was premature and overlooked critical procedural bypasses in the Sh12.5 million tender process.
“The learned judge failed to appreciate the weight of the documentary evidence and the testimonies of key witnesses,” the ODPP stated in its filing. The state contends that the governor remains accountable for the financial discrepancies noted during the procurement cycle, asserting that public funds were not utilized in accordance with the Public Procurement and Asset Disposal Act.
This legal escalation plunges the Trans Nzoia County chief back into a period of intense judicial scrutiny. Legal analysts suggest that the DPP’s persistence indicates a broader strategy to crack down on past administrative lapses by high-ranking officials.
If the appeal is successful, the governor could face a fresh trial, a scenario that would likely complicate his political standing and administrative focus. For now, the acquittal that once seemed like a legal shield has been transformed into a temporary reprieve, as the appellate court prepares to determine whether Natembeya must return to the dock to answer for the million-shilling controversy.
