Justice James Rika of the Employment and Labour Relations Court in Nairobi issued a temporary injunction.
The injunction restrains the Kenya Union of Post-Primary Education Teachers (Kuppet) from participating in industrial action.
The Teachers Service Commission’s petition was certified as urgent, leading to the suspension of the strike pending further legal proceedings.
The strike began on August 26, 2024. It was in demand for the implementation of the collective bargaining agreement between Kuppet members and the Teachers Service Commission.
The High Court decided to suspend the strike. This decision came after the Ministry of Labour and Social Protection was listed as an interested party. The Teachers Service Commission filed the case.
The matter is set to be mentioned on September 5. The court continues to handle the issues raised by the teachers’ union. The Kenya National Union of Teachers had earlier withdrawn its strike notice.
They did this after reaching an agreement with the Teachers Service Commission. Meanwhile, Kuppet remained firm on their demands. They insist until the CBA is fully implemented.
