A Nairobi family filed a complaint with the Office of the Ombudsman after their wife’s body was withheld by a hospital. The hospital demanded KSh 1.29 million in unpaid medical fees before releasing the remains. Responding to the complaint, KMPDC issued a statement emphasizing that hospitals are not legally justified to detain bodies under any circumstances.

The Council reinforced that medical facilities must instead pursue alternative legal or administrative channels to recoup fees from bereaved families.

KMPDC’s order cites Article 28 of the Constitution, which guarantees dignity to every person, noting that this protection extends posthumously. The ruling insists that detaining a body shatters that dignity.
