In a surprising move last week, Gachagua’s own legal team attempted to withdraw the very lawsuits he had filed to stop Parliament’s push to remove him.
At the center of those petitions? Eleven explosive accusations that had the nation holding its breath back in October.

But after being impeached, Gachagua called off the legal dogs, saying “events had overtaken the matter.”

Now, Maleya says: Not so fast.

He argues that dismissing those cases would set a dangerous precedent—allowing powerful figures to erase uncomfortable legal records simply because they’re no longer politically useful.

Adding fuel to the fire, the Court of Appeal has just slammed the brakes on an earlier ruling by Deputy Chief Justice Philomena Mwilu.
Mwilu had controversially formed a special three-judge bench to hear one of the petitions tied to Gachagua’s impeachment.

But in a stunning reversal on May 9, 2025, appellate judges declared that only Chief Justice Martha Koome had the authority to make such appointments—effectively invalidating the entire bench.

Now the entire case has been thrown into limbo.

All parties have now been told to stand down until further notice from the Chief Justice.
The High Court has suspended hearings. Assistant Deputy Registrar Beja Nduke confirmed this just last week.
